Smoke Alarm Compliance in Apartment Buildings – Requirements under the Residential Tenancies Act (RTA)
In New Zealand, the majority of apartment buildings are fitted with a comprehensive, building-wide smoke detection and alarm system. These systems are typically connected to a central fire panel and monitored directly by Fire and Emergency New Zealand (FENZ). As part of ongoing building compliance, such systems are generally tested annually during the building’s Warrant of Fitness (WOF) or local council inspections.
However, while these systems serve the overall safety of the building, they do not meet the specific compliance requirements set out under the Residential Tenancies Act (RTA) for individual tenancies.
Since 1 July 2016, the RTA has made it a legal requirement for landlords to ensure that working smoke alarms are installed and maintained in every rental property.
Under the RTA and relevant smoke alarm regulations:
- Landlords (or their property managers) are legally required to ensure that working smoke alarms are installed in each rental property.
- These alarms must be tested and confirmed operational prior to the commencement of any new tenancy.
- Ongoing maintenance, including battery replacements and functionality checks, must occur throughout the tenancy.
- The smoke alarms used must comply with one of six internationally recognised standards, such as AS 3786:2014, UL 217, or similar.
- Devices must be less than 10 years old and fitted with long-life batteries (if not hardwired).
Key Issue with Centralised Building Alarm Systems
While centralised alarm systems in apartment buildings are designed to alert residents to fire events across the entire structure, they often do not meet the specific standards required by the RTA for tenancy compliance. In addition:
- These complex systems are not testable on a unit-by-unit basis without triggering the entire building’s alarm system, potentially resulting in unnecessary FENZ callouts.
- The alarms are typically not located within the individual units in a manner compliant with tenancy legislation.
- Landlords cannot rely solely on the building’s central system to meet their legal obligations under the RTA.
Best Practice for RTA Compliance in Apartments
To meet the RTA’s requirements, property managers and landlords managing units in apartment buildings must:
- Install independent, stand-alone smoke alarms within each rental unit.
- Ensure these alarms meet one of the approved international standards.
- Test each unit’s smoke alarm prior to the commencement of a tenancy and maintain clear testing records.
- Conduct regular checks during routine inspections or at appropriate intervals to ensure continued functionality.
Penalties for Non-Compliance
Failure to comply with the smoke alarm requirements under the RTA can result in significant fines and legal action. The Tenancy Tribunal has consistently ruled that it is the landlord’s responsibility to ensure full compliance and that reliance on a building’s main fire system is not sufficient. Landlords may face exemplary damages of up to $7,200 for breaches, along with reputational harm and disruption to tenancies.
This is Exactly Where All Clear Comes In
At All Clear, we specialise in installing stand-alone, RTA-compliant smoke alarms in apartment units — ensuring each tenancy meets all legal requirements without disrupting the building’s main system. Our team tests alarms before a new tenancy begins and offers continued support throughout the tenancy to maintain full compliance.
Important Reminder for Property Managers and Landlords
If you are not installing and testing separate, compliant smoke alarms in apartment units prior to tenancy commencement, or if you’re relying on the central building system under the assumption that it satisfies your obligations, you are not meeting your legal responsibilities under the Residential Tenancies Act.
Tenancy Services and the Tenancy Tribunal have made it clear: compliance with the RTA is the landlord’s responsibility, regardless of the building’s fire system. Ensuring the presence and functionality of compliant smoke alarms in each individual tenancy is a non-negotiable requirement.
All Clear is here to make that simple and stress-free.
