Tenancy Tribunal Awards Nearly $20,000 After Infant Exposed to Lead in Rental Home
A recent Tenancy Tribunal decision in Napier has reinforced the serious consequences of unsafe rental housing, after an infant boy was exposed to dangerous levels of lead in a rented property. The Tribunal awarded almost $20,000 in damages, citing failures in property maintenance and tenant safety.
The case involved deteriorating lead-based paint, which exposed the child to lead through paint flakes and dust. Medical evidence showed elevated blood lead levels a particularly serious risk for infants and young children, where exposure can affect brain development and long-term health.
The Tribunal found the landlord had failed to meet their legal obligations to provide a safe and healthy home. Under New Zealand tenancy law, landlords must maintain their properties and address hazards that could cause harm, especially in older homes where lead paint may be present.
This case highlights that lead exposure is often preventable through regular inspections, timely maintenance, and proactive management. It also sends a clear message that failing to act can result in significant financial penalties and, more importantly, serious harm to tenants.
This ruling is a strong reminder for landlords and property managers across New Zealand to take safety risks seriously and act early.
